APPLICATION OF TERMS AND CONDITIONS

The following terms and conditions apply to the use of the world wide web site at https://www.breviahealth.com which is owned and operated by Brevia Limited (“the Site”).  By using the Site you are taken to accept these terms and conditions (whether or not you have read them). If you do not accept these terms and conditions you must not use the Site or any of the services or materials contained on it.

(2) COPYRIGHT AND OTHER INTELLECTUAL PROPERTY RIGHTS

2.1 The contents of the Site and the Site itself are protected by copyright and may not be copied, reproduced (whether in hard copy or electronically) or used in any way other than in the circumstances and for the express purposes set out below. The authors of the Site and the materials from time to time included on it assert their moral rights to be identified as the author and to object to a derogatory treatment of their work as provided under the Copyright Designs and Patents Act 1988.
2.2 Unless otherwise stated or further qualified in relation to a particular item appearing on the Site (for example where pre-registration and/or a fee is required or the material is available for viewing on-line only):

2.5 Operators of other web sites (unless expressly prohibited by Brevia Limited) may set up hyperlinks from their web site to the home page of the Site but not any other pages without Brevia Limited’s prior written consent.
2.6 Brevia® is a registered trademark of Brevia Limited. Other product, service and business names mentioned on the Site may be the trademarks or registered trademarks of their respective owners. No trademark should be used without the express written consent of the mark’s proprietor.
2.7 Each user hereby agrees to indemnify and hold Brevia Limited harmless from any claims, losses, awards, fines, damages, costs, and expenses made against it in respect of any breach by that user of the terms of this clause 2.

Brevia Limited reserves the right unilaterally in its sole discretion and without notice to alter or remove all or any part of the Site and/or to restrict access to it without prior notice.

4.1.3 Brevia Limited and the other contributors to the Site shall have no responsibility or liability for errors or omissions on the Site or for any loss or damage suffered as a result of any access to, use or unavailability of or reliance placed upon the Site or its contents including without limitation any effect on your computer itself or otherwise howsoever any direct or indirect loss, consequential loss, loss of data and/or any loss of income or profits (except death or personal injury caused by Brevia Limited’s negligence).

4.2.2 Brevia Limited has no and disclaims any liability in respect of such material and each contributor hereby agrees to indemnify and hold Brevia harmless from any claims, losses, awards, fines, damages, costs, and expenses made against it in respect of the same.
4.2.3 Without being under any obligation to do so Brevia reserves the right at its sole discretion to remove or edit any illegal or objectionable material.

4.4 Brevia Limited will review any requests for a free political monitoring trial and may decide, solely at its own discretion, if it wishes to offer this service to a particular applicant.

(5) AFFILIATE PROGRAMME

The Brevia affiliate programme is available to all independent public affairs companies and providers of consultancy services to companies. Brevia Limited reserve the right to refuse any applicant for any reason whatsoever. All successful applicants will be notified and a further discussion required. If both parties want to proceed, an operating agreement will be entered into to the mutual satisfaction of both parties.

(6) CHANGES

Brevia Limited reserves the right unilaterally to vary or replace these terms and conditions of use from time to time. You will be bound by any changes or replacements whether or not you re-visit or re-read this page.

(7) SEVERABILITY

If any of the provisions of these terms and conditions shall be determined invalid, unlawful or unenforceable to any extent such provision shall be severed from the remaining provisions of these terms and conditions which will continue to be valid to the full extent permitted by law.

(8) LAW AND JURISDICTION

These terms and conditions and use of the Site are governed by English law and any dispute connected with the Site shall be subject to the exclusive jurisdiction of the English courts.
